La Secretaría de Economía continúa con la segunda fase de la estrategia Operación Limpieza con el objetivo de proteger a la industria nacional, en esta ocasión, en coordinación con los gobiernos estatales de Baja California y Jalisco.
Además, estará apoyado por la Guardia Nacional, y las secretarías de seguridad pública estatales, la Secretaría de Economía realizó operaciones simultáneas para cancelar cinco empresas beneficiarias del programa IMMEX, a las que se señala de simular procesos de manufactura con empresas fachadas.
El Programa para el fomento a la Industria Manufacturera, Maquiladora y de Servicios de Exportación, conocido como IMMEX, permite el ingreso de insumos libres de aranceles para la manufactura en México con fines de exportación.
Las empresas intervenidas hoy, presuntamente han hecho mal uso del programa al importar productos terminados que se quedan y venden en el país, lo que representa una competencia desleal a la industria nacional ya que, además de no pagar aranceles, tampoco pagan IVA ni ISR.
Se trata de cinco empresas, cuatro en el estado de Baja California y una más en el estado de Jalisco, que han realizado en conjunto importaciones por 9 mil millones de pesos.
Estas son KAIZEN INC. S. DE R.L. DE C.V. y CO PRODUCTION DE TIJUANA S.A. DE C.V. ubicadas en Tijuana; SOLUCIONES EMPRESARIALES M.H. FASHION S. DE R.L. DE C.V. y PHILKOR TRENDS S. DE R.L. DE C.V. ubicadas en Ensenada, Baja California; GRUPO MAQUILADOR SIN FRONTERA S.A. DE C.V. ubicada en Zapopan, Jalisco, las cuales en su conjunto incrementaron en 1,355% sus importaciones de calzado.
La industria nacional del calzado ha presentado un incremento inusual del 959% en volúmenes de importación de pares de zapatos, lo que representa una afectación de más del 20% del mercado nacional de este importante sector productivo del país.
En operativos anteriores, la Secretaría de Economía ya había cancelado el programa IMMEX a empresas de Aguascalientes y Baja California que presuntamente realizaban operaciones simuladas de importaciones de textil confeccionado por un valor de 15 mil millones de pesos.
Esto significa que los operativos encabezados por la Secretaría de Economía en fecha reciente alcanzan un total de 24 mil millones de pesos que representan un importante quebranto a la Hacienda Pública, y un perjuicio mayor a la industria nacional.
La operación de hoy se realiza de manera conjunta con la Unidad de Inteligencia Financiera (UIF) y la Agencia Nacional de Aduanas de México, las cuales, en el ámbito de su competencia, iniciaron los procedimientos correspondientes para la cancelación de patentes de agentes aduanales y el seguimiento de activos y cuentas provenientes de esta actividad, así como de sus beneficiarios.
Adicionalmente, se dio vista al Sistema de Administración Tributaria (SAT) vía la Administración General de Auditoría de Comercio Exterior (AGACE) para que, en el ámbito de su competencia, realice las acciones correspondientes, mismas que derivarían en la obligación de un crédito fiscal y la cancelación de la certificación IVA-IEPS, con lo cual quedarían completamente neutralizadas estas empresas.
Recientemente, la Agencia Nacional de Aduanas de México ha cancelado 41 patentes aduanales que se encuentran vinculadas con este tipo de actividades, en contubernio con diferentes empresas a nivel nacional, las mismas que también están siendo observadas por la Unidad de Inteligencia Financiera y por la Secretaría de Economía.
Cabe resaltar que, derivado de las acciones realizadas por la Secretaría de Economía en protección de la industria nacional, el sector textil ha presentado una reactivación en su actividad económica, debido a una disminución considerable de estas importaciones simuladas.
