La diputada María Antonieta Pérez Reyes Integrante del Grupo Parlamentario de Morena presentó una iniciativa con carácter de decreto, con la intención de reformar diversas disposiciones del Código Penal del Estado de Chihuahua, en materia de embarazos de niñas y adolescentes así como casos de violaciones.
La legisladora detalló que concretamente se busca modificar de los Art. 320 y 321 del Código De Procedimientos Penales del Estado de Chihuahua en sus Capítulos III y IV. Para agregar la siguiente fracción en ambos artículos:
En consulta médica, por atención y/o intervención en parto o por cualquier otra circunstancia, omita reportar inmediatamente sobre el hecho al Ministerio Publico de la Fiscalía correspondiente cuando sea una menor de edad la que se encuentre embarazada.
En su exposición de motivos Pérez Reyes enfatizó que de 277 violaciones sexuales a niñas a nivel estatal durante el año 2023, 87 fueron en la región serrana, y sus madres son niñas de entre 10 y 14 años, es ”una problemática criminal que no se ha visibilizado”.
“Los embarazos de niñas y adolescentes menores de edad en el estado es un gran problema de salud pública y social lejos de ser resuelto esta sin control a pesar de que la violación sexual es un delito tipificado en las Leyes correspondientes”, dijo.
Señaló casos como el de una niña de 10 años que dio a luz en el año 2023 en la Sierra Tarahumara lo que evidenció la incidencia de embarazos infantiles en Chihuahua. Tan sólo esa región serrana concentró el 32 por ciento de los 277 registrados en la entidad durante ese año.
Otro dato que brindo María Antonieta Pérez fue que en la última actualización de la Estadística de Nacimientos Registrados publicada por el Instituto Nacional de Geografía y Estadística (Inegi) reveló que en Chihuahua durante 2023 se registraron un total de 3 mil 263 nacimientos de infantes cuya madre era menor de 17 años.
Los datos también revelan que los municipios donde se concentra la mayor cantidad de casos son Ciudad Juárez con 70, seguido de Guachochi que acumuló 37, y en tercer puesto fue de 36 registrados en la capital de Chihuahua.
A través de un análisis de información, se pudo contabilizar que son un total de 11 municipios de la Sierra Tarahumara donde se concentraron 87 casos que representan el 32 por ciento del total de las incidencias registradas en toda la entidad.
Asimismo para la asociación civil Centro de Atención a la Mujer Trabajadora, que atiende a jornaleras y comunidades indígenas, es una problemática criminal que no se ha visibilizado porque es violación infantil y muchas veces las clínicas rurales no lo reportan ni las fiscalías lo siguen de oficio.
“Es un grave problema que nos afecta y nos responsabiliza a todos, especialmente los que tenemos en alto encargo de tomar decisiones por el bienestar y cuidado de los chihuahuenses”, sostuvo.
