Con 17 votos a favor y 12 en contra, la mayoría de votos, el Congreso del Estado de Chihuahua llamó de manera urgente a los poderes Legislativo, Ejecutivo y Judicial, a nivel federal, para resolver inmediatamente la “crisis constitucional que enfrenta el país”.
A propuesta del diputado y coordinador del Grupo Parlamentario de Movimiento Ciudadano (GPMC), Francisco Sánchez Villegas, el tema fue debatido ampliamente entre el Pleno, pues tanto su bancada, como la del PAN y del PRI, señalaron que “las ambiciones del régimen” en temas como la de imponer la reforma judicial vigente, genera “múltiples efectos nocivos para las familias chihuahuenses, al trastocar el estado de derecho y la seguridad jurídica”, Morena y PT defendieron su aprobación, implementación, y objetivos.
Sánchez Villegas expuso que el partido oficialista ha provocado una crisis constitucional, en la que en lugar de asumir una madurez republicana, se azuza a sus huestes para que amenacen, insulten, desprecien y generen discurso de odio contra el Poder Judicial.
“Hoy lo declaro: ¡Estamos en una crisis constitucional! Los poderes en los que hemos depositado nuestra soberanía no dialogan, no se obedecen, no se coordinan. Los Poderes de la Unión no se ordenan para servir a los ciudadanos, sino para destruirse entre sí”, dijo.
Apuntó que el régimen centralista se ha “esmerado” en desmantelar a las instituciones que tanto trabajo costó diseñar, como los organismos constitucionalmente autónomos, que emergieron de la sociedad civil, todo con “el único fin de concentrar poder”.
La proposición del GPMC argumentó que al momento existen varias suspensiones contra la citada reforma, pero la presidenta de México, Claudia Sheinbaum, y el Legislativo han decidido ignorarlas, porque el referido Poder “no tiene capacidad para decidir sobre un tema que le impacta directamente”.
Sin embargo, en lugar de presentar recursos legales que sigan los cauces judiciales establecidos, han optado por llevar el tema al debate público, lo cual ha incrementado las tensiones entre los poderes del Estado, advirtió.
Enfatizó que la situación alcanzó un nuevo punto crítico cuando una jueza federal emplazó a Claudia Sheinbaum a un plazo de 24 horas para retirar la publicación de la reforma judicial y suspender su ejecución, de lo contrario, se aplicarían las penas por desacato, pero esta dijo que no cumpliría con la orden, al afirmar que “ni una jueza, ni ocho ministros pueden parar la voluntad del pueblo de México”.
Subrayó que esta negativa pone en “grave riesgo el Estado de derecho” y abre la puerta a “una crisis institucional sin precedentes”.
Lo más peligroso, recalcó, es que si las leyes dejan de ser respetadas y aplicadas, el Juicio de Amparo y la Constitución misma podrían quedar como “meros adornos jurídicos, despojados de su efectividad en la defensa de los derechos ciudadanos”.
En su discurso, el líder de la bancada naranja, pidió evitar “el punto de no retorno” y “ de que no generemos una solución inmediata de que ”no nos veamos como enemigos jurados, sin posibilidad de coincidir”.
Recalcó que “el principal recurso en una nación no es el petróleo, no es el litio, no son los minerales, es la seguridad jurídica”.
Empero, advirtió que la crisis “apenas comienza”, porque habrá un escenario todavía más catastrófico cuando la Suprema Corte de Justicia de la Nación cumpla con su mandato constitucional, y declare “inconvencionales” la reformas a la “mal llamada reforma al Poder Judicial”.
“¿También se va a desacatar esa resolución de la Corte? El caos, la crisis, es inevitable. Sin embargo debemos comprender que lo que está en juego es el futuro de la patria y está sucediendo en nuestra guardia, Chihuahua no debe padecer las consecuencias de este caos, de esta indolencia y crisis constitucional, generada desde el centralismo perverso”, apuntó.
