El Tribunal Estatal de Justicia Administrativa (TEJA) ordenó la inhabilitación por 1 año a A.C.P.R.L.A (Araly Cristina Paulina del Rocío), exdirectora administrativa de Comunicación Social del Gobierno del Estado, en el 2018.
La exfuncionaria estatal fue declarada responsable de irregularidades administrativas, por instruir la compra de un equipo de cómputo de alta gama por 352 mil 943.60 pesos y de una cámara fotográfica por 73 mil 269.21 pesos.
Esto debido a que no se apegó a los procedimientos establecidos en la Ley de Adquisiciones, Arrendamientos y Contratación de Servicios del Estado, autorizando dos “contratos simplificados” sin que éstos estén contemplados en la legislación aplicable.
El procedimiento fue iniciado por la Auditoría Superior del Estado (ASE) que, tras la revisión de la Cuenta Pública 2018, detectó irregularidades en la Coordinación de Comunicación Social, por lo que integró las denuncias correspondientes tanto por la vía administrativa como por la penal.
El Órgano Jurisdiccional tuvo por acreditado que, para completar el supuesto estudio de mercado que debía tener al menos tres opciones de costos para ser válido, la ex servidora pública presentó un documento apócrifo con la cotización de una empresa inexistente, denominada TK Soluciones en Sistemas S.A de C.V, de la cual no fue encontrado registro oficial alguno.
Por estos motivos, el magistrado Luis Eduardo Naranjo Espinoza, titular de la Cuarta Sala Unitaria Especializada en Materia de Responsabilidades Administrativas, consideró plenamente probada la existencia de la falta de abuso de funciones por parte de la funcionaria, como contempla el artículo 57 de la Ley General de Responsabilidades Administrativas.
“Se impone a la exservidora pública A.C.P.R.L.A la inhabilitación para desempeñar cargos, empleos o comisiones en el servicio público y para participar en adquisiciones, arrendamientos, servicios u obras públicas por un año”, establece la resolución dictada dentro del expediente 047/2024-1 JRA y notificada a la ASE como parte denunciante.
