Las tres juezas liberales de la Corte Suprema disintieron públicamente de la decisión.
La jueza federal de distrito Maame Frimpong, con sede en Los Ángeles, había emitido la orden el 11 de julio. Frimpong consideró que las acciones del Gobierno de Trump probablemente violaban la protección de la Cuarta Enmienda de la Constitución de los Estados Unidos contra registros e incautaciones irrazonables. La orden de la jueza se aplicó a la jurisdicción de su tribunal que abarca gran parte del sur de California.
En una presentación escrita, el Departamento de Justicia defendió la selección de personas utilizando un “perfil razonablemente amplio” en una región en la que, según el Gobierno, alrededor del 10 por ciento de los residentes se encuentran ilegalmente en el país.
La solicitud del Gobierno es su más reciente apelación ante la Corte Suprema para tratar de seguir adelante con políticas que tribunales inferiores han bloqueado tras poner en duda su legalidad. La Corte Suprema, que tiene una mayoría conservadora de 6-3, ha respaldado a Trump en gran parte de estos casos.
