En virtud de qué esté 4 de septiembre, quedó sin efectos la suspensión definitiva dictaminada por un juez federal, dejando expeditos los derechos de la Fiscalía Anticorrupción para ejecutar las órdenes de aprehensión vigentes por PECULADO AGRAVADO
Derivado de las tres órdenes de aprehensión solicitadas por la Fiscalía Anticorrupción del Estado de Chihuahua y obsequiadas por Jueces de Control en contra del exsecretario de Hacienda, AFV, por delitos de peculado agravado en tres distintos hechos que superan los 743 MILLONES DE PESOS los Juzgados de Distrito dejaron sin efectos la suspensión definitiva por lo que el imputado se encuentra sustraído de la acción de la justicia (PRÓFUGO) por tres distintas causas penales.
En los tres casos, el imputado promovió demandas de juicio de amparo en contra de las órdenes de captura, obteniendo suspensiones definitivas condicionadas a presentarse ante la autoridad judicial correspondiente en un plazo de tres días. Dichas medidas no lo eximían de enfrentar los procesos penales, sino que únicamente le otorgaban la oportunidad de comparecer voluntariamente. Sin embargo, AFV incumplió con esa obligación en cada una de las suspensiones obtenidas.
En la primera, notificada el 15 de mayo de 2023, el propio imputado informó al Juzgado de Distrito, mediante oficio, que había decidido no comparecer por así convenir a sus intereses. Mientras que, en las otras dos, simplemente dejó transcurrir el plazo sin acudir ante los jueces de control que emitieron las órdenes de aprehensión.
Ante tales incumplimientos, los Juzgados de Distrito determinaron este día revocar las suspensiones, por lo que el imputado quedaría formalmente sustraído de la acción de la justicia en los tres procesos.
Cabe recordar que se trata de tres delitos, por hechos distintos: Caso Ichisal por $401,364,155.59; caso Fosech por $243,207,212.42 y contratación de despacho particular para reestructurar Deuda Pública por $98,600,000.00.
Esta situación confirma que, aunque por un lado buscó la protección federal, el imputado nunca tuvo la intención de someterse al escrutinio judicial, conducta que robustece los señalamientos de esta Fiscalía al momento de solicitar las órdenes de aprehensión.
Asimismo, se informa que la Fiscalía Anticorrupción se encuentra impulsando los mecanismos internacionales para la localización y captura del imputado, en virtud de su condición de ciudadano de los Estados Unidos de América.
Con estas acciones, la Fiscalía Anticorrupción del Estado de Chihuahua reitera su compromiso de llevar cada caso hasta sus últimas consecuencias, y combatir los delitos por hechos de corrupción sin excepción alguna y defender los intereses de la sociedad chihuahuense con estricto apego a la ley, la presunción de inocencia y el debido proceso
