El legislador por morena Óscar Avitia Arellanes sometió ante el Congreso el proyecto con carácter de decreto con el fin de de adicionar y reformar la Ley Estatal de Educación, así como la Ley de Presupuesto de Egresos, Contabilidad Gubernamental y Gasto Público del Estado de Chihuahua, en relación al derecho humano a la educación.
El diputado juarense expuso que las asignaciones presupuestales a la educación pueden verse afectadas por factores económicos o decisiones administrativas e impactar negativamente en la gestión escolar, pese a que el principio de progresividad del gasto educativo está reconocido en diversos instrumentos jurídicos nacionales e internacionales.
‘Lo anterior significa que el derecho a la educación, como derecho fundamental, no puede ser víctima de retrocesos presupuestales, de lo contrario el ejercicio pleno del derecho humano quedaría comprometido’ alertó el diputado Avitia, donde las disminuciones en las asignaciones presupuestales dañan de forma severa el presente y el futuro de niñas, niños, adolescentes y jóvenes.
Abundó que dicho principio de progresividad en el gasto educativo significa que el presupuesto destinado a este rubro no debe disminuir bajo ningún concepto, por esa razón, los recursos deben aumentar conforme crecen las necesidades educativas y las capacidades financieras del Estado, entidades federativas y los municipios. ‘Con esta reforma buscamos consolidar el compromiso del Estado de Chihuahua con una política educativa sostenible que permita mantener y mejorar las condiciones de aprendizaje, infraestructura, así como el desarrollo docente’ agregó.
Por ello solicitó que se reforme la Ley Estatal de Educación y se exija que para el ejercicio pleno del derecho humano a la educación, bajo el principio de progresividad, se priorizará aumentos presupuestales anuales. Siendo el Estado quien garantice una asignación que no deberá ser inferior al ejercicio inmediato anterior.
Mientras que para la ley de Ley de Presupuesto de Egresos, Contabilidad Gubernamental y Gasto Público del Estado de Chihuahua, se pide que en cuanto al derecho humano a la Educación, la programación y presupuestación se considerarán de utilidad pública, por lo cual el recurso destinado no podrá ser menor al ejercicio fiscal inmediato anterior. Por lo que respecta al ejercicio, en caso de una disminución de ingresos la autoridad hacendaria estatal no podrá disminuir el recurso destinado a educación.
Concluyó el legislador que el incremento progresivo del presupuesto en materia educativa permitirá a las nuevas generaciones contar con más capacidades en el marco de una política nacional direccionada al rescate de los valores de comunidad, sin perder de vista la formación individual y familiar.
