El diputado Alfredo Chávez Madrid, coordinador del Grupo Parlamentario del PAN en el Congreso del Estado, presentó una iniciativa para reformar la Ley de Aeropuertos con el objetivo de que los servicios comerciales que operan dentro de los aeropuertos no estén exentos del pago de contribuciones estatales y municipales, en particular del impuesto predial.
En compañía del senador del PAN por Chihuahua, Mario Vázquez, puntualizó que la propuesta plantea adicionar un segundo párrafo a la fracción III del artículo 48 de dicha ley, a fin de precisar que las actividades comerciales dentro de inmuebles aeroportuarios, al no formar parte del servicio público concesionado, deben cumplir con las obligaciones fiscales correspondientes, conforme a lo establecido en el artículo 115 constitucional.
El legislador explicó que actualmente existe un vacío legal que ha permitido que negocios con fines de lucro, ubicados dentro de aeropuertos, evadan el pago del predial bajo el argumento de encontrarse en bienes de dominio público federal. Como ejemplo, citó el caso de los aeropuertos internacionales de Chihuahua y Ciudad Juárez, concesionados al Grupo Aeroportuario del Centro-Norte (OMA), donde el municipio dejó de percibir recursos estimados en alrededor de 33 millones de pesos tras un juicio contencioso administrativo promovido por el concesionario.
Finalmente, el senador Mario Vázquez, presidente de la Comisión de Desarrollo Municipal en el Congreso de la Unión, señaló que dará seguimiento a esta iniciativa en el ámbito federal, la cual calificó como oportuna ante el trato que la Federación ha dado a los municipios. Subrayó que el planteamiento busca fortalecer las haciendas municipales y corregir desequilibrios que hoy afectan directamente a los gobiernos locales.
