El exoficial mayor y el tesorero del Municipio de Madera, identificados con las iniciales J.M.P y S. M.M. respectivamente, fueron inhabilitados para ejercer cargos públicos por 10 años al ser encontrados responsables de las faltas administrativas de peculado, desvío de recursos y abuso de confianza.
Los exfuncionarios fueron declarados administrativamente responsables de utilizar recursos públicos durante la administración municipal 2019-2021.
Esto sucedió en la adquisición de refacciones automotrices para la reparación de vehículos propiedad de los funcionarios.
La Auditoría Superior del Estado (ASE) detectó que el exoficial mayor solicitó la compra de refacciones para un vehículo de su propiedad, por un monto de 22 mil 100 pesos.
De acuerdo con la investigación de la ASE, el entonces tesorero autorizó en total el gasto de poco más de 45 mil pesos para cubrir las refacciones solicitadas por el exoficial mayor y para la compra de llantas de refacción de vehículos particulares.
Tras hacer la observación y determinar una posible falta, el ente fiscalizador turnó el expediente al Tribunal Estatal de Justicia Administrativa (TEJA), instancia ante la cual quedó plenamente demostrada la responsabilidad de los exservidores que formaron parte de la administración 2019-2021 y el daño ocasionado a las finanzas públicas municipales.
La sentencia dictada por el TEJA asentó que para la erogación de recursos públicos no basta que se exhiban órdenes de compra y las facturas relacionadas, sino que debe comprobarse que los recursos públicos se utilizaron para satisfacer intereses colectivos y no los particulares.
En estos casos, quedó acreditado que los ahora responsables actuaron en contravención con las normas a las que debía sujetarse su actuación, encontrándose responsables de violaciones graves a la Ley General de Responsabilidades Administrativas.
Por este motivo, además de la inhabilitación temporal de 10 años, les fue impuesta una sanción económica por 25 mil pesos en el caso de J.M.P, así como el reintegro de los 22 mil 100 pesos con los que se benefició indebidamente; mientras que a S.M.N. se le impuso la responsabilidad de reponer los 45 mil 098 pesos erogados de forma irregular.
La sentencia fue emitida por la Cuarta Sala Especializada en Materia de Responsabilidades Administrativas del TEJA.
