Tras el asesinato del alcalde de Uruapan, Carlos Manzo, que causó conmoción en México, la Fiscalía General de Michoacán afirmó que uno de sus escoltas mató al homicida con la misma arma con la que asesinaron al alcalde. Pero un peritaje solicitado por la defensa, determinó que los casquillos son de dos armas diferentes.
El peritaje en balística, solicitado por la defensa, concluyó que la bala que mató al asesino de Carlos Manzo fue disparada con la pistola de un escolta, contrario a lo que afirma la Fiscalía General de Michoacán, encabezada por Carlos Torres.
En su versión, la fiscalía aseguró que los siete disparos realizados en la plaza de Uruapan el 1 de noviembre salieron de una sola pistola: la Pietro Beretta 9 milímetros que usó el adolescente y que tiene la matrícula borrada.
Seis disparos fueron dirigidos contra Manzo, pero el séptimo fue contra el propio homicida, según la fiscalía, la cual señaló al escolta Demetrio de la Cruz de utilizar la pistola del propio asesino para matarlo.
A petición de la defensa de los escoltas, un criminalista privado analizó los casquillos de las siete balas que la fiscalía recolectó en la plaza de Uruapan menos de una hora después del crimen.
Seis de ellos son grises, tienen las palabras “Luger Mon”, fueron recopilados en la zona de la plaza donde el adolescente hirió a Manzo y fueron etiquetados como indicios 1, 2, 3, 4, 5 y 7.
El séptimo casquillo es dorado, tiene la leyenda “Águila” y fue localizado en la jardinera donde los escoltas del alcalde forcejearon con el homicida y uno de ellos, Demetrio de la Cruz, le disparó. La fiscalía lo etiquetó como indicio 9.
El criminalista encontró que el séptimo casquillo o indicio 9 tiene marcas de disparo distintas a las que tienen los otros seis.
En particular, la pistola del homicida deja en los casquillos una marca en forma de “C”, como se observa en la imagen del casquillo marcado como indicio 5.
El indicio 9 tiene una huella en forma de punto que coincide con la marca que deja la pistola de cargo del escolta Demetrio de la Cruz, también calibre nueve milímetros.
Esto se observa en otros dos casquillos llamados “testigos” que la propia fiscalía obtuvo al disparar el arma de cargo de De la Cruz para hacer la comparación.
“Este casquillo marca ‘Águila’ no tiene esta característica, que es muy notoria en todos, de la C”, señaló a Latinus el abogado de la defensa Gustavo Carreón en entrevista.
La versión de una sola arma forma parte de los señalamientos de la fiscalía contra los escoltas, actualmente presos, quienes enfrentan un proceso por el homicidio de Manzo luego de que la institución los acusó de ser omisos en su seguridad.
La defensa presentó el dictamen balístico como dato de prueba ante el juez, pero la fiscalía que encabeza Carlos Torres insiste en que el homicida fue abatido con su propia arma.
Cuestionado al respecto en una rueda de prensa, el fiscal aseguró que no hay error y desestimó el peritaje presentado por la defensa.
“Fue la misma arma. Ellos traen una prueba pericial, se respeta. Será el juez el que determine”, respondió el fiscal a pregunta expresa el 28 de noviembre.
El abogado de la defensa dijo que “retaría al fiscal a que científicamente salga a los medios, así como ha difundido información y justifique por qué considera que sí es el arma”.
Carreón se pregunta cómo pudieron incurrir los escoltas en una omisión en el asesinato del alcalde si, por ejemplo, la oficial Monserrat Hernández sufrió un rozón de bala al abrazar a Manzo cuando el adolescente disparó.
El expediente clínico del hospital que atendió a la escolta puntualiza que sufrió “agresión con disparo de arma corta”, pero el juez no tomó en cuenta la prueba, criticó el abogado.
“Se habla de una omisión, ¿cuál omisión? Se les debió precisar en qué consistió en esa omisión, qué fue lo que hicieron mal, si la agresión duró 1.5 segundos y en ese 1.5 segundos la escolta Monserrat alcanzó a abrazar al alcalde”, afirmó.
El fiscal de Michoacán, Carlos Torres, también dijo públicamente que la detención fue en un operativo con fuerzas federales, pero la defensa asegura que ocurrió en el cuarto de piano de la casa de cultura de Uruapan, donde los escoltas acudieron voluntariamente tras ser llamados para un acto de investigación y que ellos en ningún momento opusieron resistencia.
De ser hallados culpables de actuar con dolo o intencionalmente, como señala la fiscalía, los escoltas de Carlos Manzo podrían enfrentar penas de 20 a 50 años de cárcel.
