Publica la Federación en el Diario Oficial “Supremacía Constitucional”

El Ejecutivo Federal publicó este jueves en el Diario Oficial de la Federación las modificaciones a la Ley de Amparo que impide que jueces del Poder Judicial puedan suspender reformas constitucionales y que establece como mínimo seis votos de los ministros del pleno del Máximo Tribunal para alcanzar la mayoría calificada.

“Las sentencias que se pronuncien en los juicios de amparo sólo se ocuparán de las o los individuos particulares o de las personas morales, privadas u oficiales que lo hubieren solicitado, limitándose a ampararlas y protegerlas, si procediere, en el caso especial sobre el que verse la demanda. Tratándose de juicios de amparo que resuelvan la inconstitucionalidad de normas generales, en ningún caso las sentencias que se dicten fijarán efectos generales”, dice el decreto de la presidenta Claudia Sheinbaum Pardo publicado en el DOF.

Estas modificaciones enviadas por la titular del Ejecutivo federal responden a la lluvia de amparos que se promovieron por parte de los trabajadores del Poder Judicial durante el proceso Legislativo para aprobar la reforma que somete a voto popular la elección de los impartidores de justicia y para evitar que fuera publicada en Diario Oficial.

Ese tema llegó hasta la Suprema Corte de Justicia de la Nación, se intentó frenar la reforma judicial, sin embargo, no se detuvo.

Entre otra de las modificaciones a la Ley de Amparo se establece que para avalar asuntos que requieren mayoría calificada en la Suprema Corte de Justicia de la Nación (SCJN) se necesitarán seis votos de los ministros, hasta hoy se necesitaban ocho votos de los ministros.

“Artículo 222. Las razones que justifiquen las decisiones contenidas en las sentencias que dicte el Pleno de la Suprema Corte de Justicia de la Nación, constituyen precedentes obligatorios para todas las autoridades jurisdiccionales de la Federación y de las entidades federativas cuando sean tomadas por mayoría de seis votos. Las cuestiones de hecho o de derecho que no sean necesarias para justificar la decisión no serán obligatorias”, dice el decreto Presidencial.

Las modificaciones a Ley de Amparo se publicaron este jueves y entran en vigor el día 14 de marzo del presente año.

Esta reforma fue criticada por la Confederación Patronal de la República Mexicana, señaló que estos cambios afectan los derechos fundamentales y que se trata de un golpe al Estado de derecho.
