El Congreso de Chihuahua envió una iniciativa de decreto al Congreso de la Unión, a fin de elevar a rango constitucional el derecho al acceso de energía eléctrica, destinada al consumo personal, doméstico y educativo, en condiciones de asequibilidad, confiabilidad, sostenibilidad y renovación, de manera moderna, segura y con altos estándares de calidad.
La diputada Brenda Ríos, presidente de la Comisión de Energía, expuso que el artículo 25 de la Declaración Universal de los Derechos Humanos, indica que, toda persona tiene derecho a un nivel de vida adecuado que le asegure, así como a su familia, la salud y el bienestar, y en especial la alimentación, el vestido, la vivienda, la asistencia médica y los servicios sociales necesarios.
Varios instrumentos y observaciones internacionales refieren sobre el derecho a una vivienda adecuada, energía para la cocina, calefacción y alumbrado, a agua potable, e instalaciones sanitarias y de aseo, de almacenamiento de alimentos, y a servicios de emergencia; entre otros.
Ahora bien, se infiere también que el nivel de vida adecuado, al que tienen derecho todas las personas, comprende también, las condiciones materiales mínimas que la población necesita para asegurar su subsistencia; y entre ellas está, el acceso a la energía eléctrica, por ello la necesidad de considerarlo como un derecho humano.
Con la petición para que se adicione al artículo 4°, un décimo noveno párrafo, de la Constitución Política de los Estados Unidos Mexicanos, se enfatiza en la consolidación de reformas que no sólo enuncien los derechos de las y los mexicanos, sino que permitan contar con herramientas eficaces para lograr el pleno ejercicio de sus garantías.
Por último cabe mencionar que dentro de los artículos transitorios del proyecto de decreto, se señala entre otras cuestiones, que para garantizar el cumplimiento de este derecho, se deberán destinar los recursos necesarios al Presupuesto de Egresos de la federación, asegurando a largo plazo una asignación progresiva de recursos económicos para ampliar la cobertura de energía eléctrica, impulsar su transición hacia un modelo sustentable, seguro y fiable, y promover su modernización continua.
Asimismo, que la Ley Reglamentaria respectiva, establecerá los rangos tarifarios para el acceso a la electricidad como derecho básico y la provisión mínima de este servicio. Se buscará equilibrar el acceso universal con la sostenibilidad financiera y ambiental del sistema eléctrico.
